Terms and Conditions

The owner of the online shop studio27.ee (hereinafter the Online Shop) is Studio 27 OÜ (registry code 17389172), located at Manufaktuuri 16–78, Tallinn 10323, Estonia.

These terms apply when purchasing goods from the Online Shop.


Validity of the Sales Agreement, Product and Price Information

The sales terms apply to all purchases made from the Online Shop.

Product prices are displayed next to the products. Delivery fees are added to the price.

Delivery costs depend on the buyer’s location and the selected delivery method and are shown during checkout.

Product information is displayed directly next to each product in the Online Shop.


Placing an Order

To place an order, the customer must add the desired products to the shopping cart. To complete the order, required fields must be filled in and a suitable delivery method selected. The total amount payable is then displayed and can be paid via a bank link or another payment solution.

Payments are processed by Maksekeskus and Voog Pay. Payment is made outside the Online Shop in a secure environment. The seller does not have access to the customer’s bank or card details.

The sales contract enters into force once the payable amount has been received in the Online Shop’s bank account.

The Online Shop owner is the controller of personal data and forwards personal data necessary for payment processing to authorised payment service providers.

If the ordered product cannot be delivered due to stock shortage or for any other reason, the customer will be notified at the earliest opportunity, and all paid amounts (including delivery costs) will be refunded without delay, but no later than within 14 days of sending the notice.


Delivery

Goods are delivered within Estonia. International delivery may be arranged by agreement. Delivery services are provided by Omniva, SmartPosti, DPD and Unisend.

Delivery costs are borne by the buyer and are displayed alongside the delivery method.

Domestic deliveries within Estonia usually arrive at the destination specified by the buyer within 3–7 business days from the entry into force of the sales contract.

Studio 27 products are freshly made and therefore dispatched as soon as possible, but no later than within 5 business days.

In exceptional cases, delivery may take up to 30 calendar days.


Taganemisõigus

Pärast tellimuse kättesaamist on ostjal õigus e-poes sõlmitud lepingust taganeda 14 päeva jooksul vaid juhul kui toodet ei ole kasutatud (küünalt ei ole süüdatud) ega kahjustatud. Taganemisõigus ei kohaldu, kui ostjaks on juriidiline isik või on tehtud eritellimus.

14-päevase tagastamisõiguse kasutamiseks ei tohi tellitud kaupa kasutada muul viisil kui on vajalik kauba olemuses, omadustes ja toimimises veendumiseks viisil nagu see on lubatud kauba testimiseks füüsilises poes.

Kui kaupa on kasutatud muuks otstarbeks kui on vajalik kauba olemuses, omadustes ja toimimises veendumiseks või sellel on kasutamise või kulumise märke, on Veebipoel õigus alandada tagastatavat tasu vastavalt kauba väärtuse vähenemisele.

Kauba tagastamiseks tuleb esitada vabas vormis kauba ostmisest taganemise avaldus ning saata see e-posti aadressile info@studio27.ee hiljemalt 14 päeva jooksul kauba kättesaamisest.

Kauba tagastamise kulud kannab ostja, välja arvatud juhul, kui tagastamise põhjus seisneb asjaolus, et tagastamisele kuuluv asi ei vasta tellitule (nt vale või defektiga asi).

Ostja peab kauba tagastama avalduse esitamisele järgneva 14 päeva jooksul või esitama tõendi, et ta on eelnimetatud perioodi jooksul kauba üle andnud kauba vedajale.

Veebipood tagastab tagastatava kauba kättesaamisel ostjale viivitamata, kuid mitte hiljem kui 14 päeva möödumisel arvates taganemisavalduse saamisest, kõik ostjalt lepingu alusel saadud tasud.

Veebipood võib keelduda tagasimaksete tegemisest seni, kuni on lepingu esemeks oleva asja tagasi saanud või kuni ostja on esitanud tõendid, et on asja tagasi saatnud, sõltuvalt sellest, kumb toimub varem.

Kui ostja on sõnaselgelt valinud Veebipoe pakutud kõige odavamast tavapärasest asja kättetoimetamise viisist erineva viisi, ei pea Veebipood tarbijale tagastama kulu, mis ületab tavapärase kättetoimetamise viisiga seotud kulu.

Veebipoel on õigus taganeda müügitehingust ning nõuda ostjalt tagasi kaup, kui kauba hind veebipoes on eksituse tõttu märgitud oluliselt alla kauba turuhinna.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract within 14 days, provided that the product has not been used (the candle has not been lit) and has not been damaged. The right of withdrawal does not apply if the buyer is a legal entity or if the product was custom-made.

To exercise the 14-day right of withdrawal, the product may only be handled in a manner necessary to verify its nature, characteristics and functioning, as would be allowed in a physical store.

If the product has been used beyond what is necessary or shows signs of use or wear, the Online Shop has the right to reduce the refund amount in proportion to the decrease in value.

To return the product, the buyer must submit a withdrawal notice in free form and send it to info@studio27.ee no later than 14 days after receiving the goods.

Return shipping costs are borne by the buyer, except when the reason for return is that the product does not correspond to the order (e.g. incorrect or defective product).

The buyer must return the goods within 14 days after submitting the withdrawal notice or provide proof that the goods have been handed over to the carrier within that period.

Upon receiving the returned goods, the Online Shop will refund all amounts received from the buyer without delay, but no later than 14 days after receiving the withdrawal notice.

The Online Shop may withhold the refund until the returned item has been received or until proof of return shipment has been provided, whichever occurs first.

If the buyer has expressly chosen a delivery method other than the least expensive standard delivery option offered by the Online Shop, the Online Shop is not obliged to refund the additional delivery cost.

The Online Shop has the right to withdraw from a sales transaction and demand the return of goods if the product price was mistakenly displayed significantly below market value.


Right to Submit a Complaint

The Online Shop is liable for non-conformity or defects in goods that existed at the time of delivery and become apparent within two years from delivery. Within the first six months, it is presumed that the defect existed at the time of delivery, unless proven otherwise by the Online Shop.

In case of a defect, the buyer must contact the Online Shop within two months by emailing info@studio27.ee.

The Online Shop is not responsible for defects that arise after the goods have been delivered to the buyer.

If the product has defects for which the Online Shop is responsible, the product will be repaired or replaced. If repair or replacement is not possible, all amounts paid under the sales contract will be refunded.

Complaints will be responded to in writing within 15 days.


Direct Marketing and Processing of Personal Data

The Online Shop uses the personal data entered by the customer only for processing orders and delivering goods to the customer. The Online Shop transfers personal data to companies providing delivery services solely for the purpose of delivering the goods.

The Online Shop sends newsletters and promotional offers to the customer’s email address only if the customer has expressed their wish to receive such communications by entering their email address on the website and giving consent to receive direct marketing messages.

The customer may unsubscribe from promotional emails and newsletters at any time by notifying us via email or by following the instructions provided in the promotional email.


Dispute Resolution

If the customer has any complaints regarding the Online Shop, they must be sent by email to info@studio27.ee.

If the customer and the Online Shop are unable to resolve the dispute by agreement, the customer may contact the Consumer Disputes Committee.

The Consumer Disputes Committee is authorised to resolve disputes arising from contracts concluded between the customer and the Online Shop. The review of the customer’s complaint by the committee is free of charge.

The customer may also use the European Union Online Dispute Resolution (ODR) platform to resolve disputes.
